Vuse Ultra Trial Services 

 

1. About Us 

 

1.1  Vuse is a trading name of Nicoventures Retail (UK) Limited whose registered office is at Building 7, Chiswick Business Park, 566 Chiswick High Road, London, W4 5YG ("we", "our", or "us" as applicable). 

 

1.2  The Vuse Ultra Trial Terms & Conditions ("Terms") are listed below. If you have any questions about our trial services or products, please contact the Vuse Ultra Care team at 0800 175 1555. The Vuse Ultra Care team is a dedicated team provided by us for our Vuse Ultra customers. The Vuse Ultra Care team operates within the hours of 8am to 9pm Monday to Saturday excluding Bank Holidays. 

 

1.3  We may amend these Terms from time to time. Unless we expressly provide a delayed effective date, these amendments will be immediately effective on the posting of such updated Terms. If we make any significant adjustments to these Terms that will impact on you, we will provide you with reasonable notice of the changes by email to the Account Profile (as described below) you have registered for the Vuse Ultra Trial. In these circumstances you will have the opportunity to cancel your Vuse Ultra Trial.Following the expiry of this notice, your continued use of our Vuse trial services will constitute your consent to be bound by the Terms. Please check this page occasionally to ensure that you're happy with any changes to these Terms. 

 

2. How to join the Vuse Ultra Trial 

 

2.1  To be eligible to join the Vuse Ultra Trial, you must be an existing nicotine user, aged 18 years or over, with a UK registered postal address, have an Account Profile (as described below) set up within Vuse.com and provide a valid Visa, MasterCard or American Express payment method (“Payment Method”) and you must not have joined any other Vuse Ultra trial provided by us or purchased a Vuse Ultra Device (as defined below) previously on Vuse.com ("Trial Requirements"). 

 

2.2  To be eligible to join the Vuse Ultra Trial, you must be an existing nicotine user, aged 18 years or over, with a UK registered postal address, have an Account Profile (as described below) set up within Vuse.com and provide a valid Visa, MasterCard or American Express payment method (“Payment Method”) and you must not have joined any other Vuse Ultra trial provided by us or purchased a Vuse Ultra Device (as defined below) previously on Vuse.com ("Trial Requirements"). 

 

2.3  The Vuse Ultra Trial created by you will become immediately effective upon completion of the checkout process, until such time as the Vuse Ultra Trial is completed, cancelled or terminated (as described below). 

 

2.4  Once you have successfully joined the Vuse Ultra Trial you will receive an email from us to confirm that your Vuse Ultra Trial is active, and the date of this email shall be considered the “Activation Date”. If you do not receive an email confirmation of your Vuse Ultra Trial, please contact the Vuse Care Line to confirm that your Vuse Ultra Trial has successfully been purchased. 

 

2.5 Once you have successfully joined the Vuse Ultra Trial you will receive an email from us to confirm that your Vuse Ultra Trial is active, and the date of this email shall be considered the “Activation Date”. If you do not receive an email confirmation of your Vuse Ultra Trial, please contact the Vuse Care Line to confirm that your Vuse Ultra Trial has successfully been purchased. 

2.6  If we discover that you do not meet the Trial Requirements, we will, at our discretion, cancel your Vuse Ultra Trial and bill the Payment Method associated with your Account Profile twenty pounds (£20) for the Products (as described below) that have been delivered to you.  

 

3. Vuse Ultra Trial  

 

3.1  On or around the Activation Date, we will ship to you: (i) the premium smart vape device (the “Vuse Ultra Device”), priced at twenty pounds (£20); and (ii) one (1) pack of corresponding smart vape pods for the Vuse Ultra Device (the “Vuse Ultra Pods”) priced at four pounds (£4), together the “Products”. The Products may be used in conjunction with the “My Vuse App”, available to download for free on the Apple App Store and Google Play Stores.  

 

3.2  The Vuse Ultra Trial period shall begin immediately after the Activation Date and end fourteen (14) days after the Activation Date (“Trial Period”). For example, if you join the Vuse Ultra Trial on 1June 2026:  

 

3.2.1  The Activation Date will be 1 June 2026; 

3.2.2  The Products will be shipped to you on or around 1 June 2026; 

3.2.3  Your Trial Period will begin on 1 June 2026; and 

3.2.4  Your Trial Period will end on 15 June 2026.  

 

3.3  During the Trial Period you will be able to trial the Products which have been delivered to you by us. You will be billed for the Products using the Payment Method associated with your Account Profile after the Trial Period ends in accordance with clause 17 below. 

 

3.4  Following the end of the Trial Period, your Vuse Ultra Trial will be complete. 

 

4. Cancelling Your Vuse Ultra Trial 

 

4.1  If you wish to cancel your Vuse Ultra Trial and return the Products you may do so at any point during the Trial Period only (“Return”) by following the process set out below, or by contacting the Vuse Ultra Care team. Following the Trial Period you will not be entitled to return the Products and we will bill the Payment Method associated with your Account Profile twenty pounds (£20) which is the cost of the Products that have been delivered to you.  

 

4.2 If you wish to initiate a Return of your Vuse Ultra Trial Products you can do so by logging in to your Account Profile and accessing your Vuse Ultra Trial. If you initiate a valid Return during the Trial Period, we will send you a pre-paid, tracked, postage label to return the Vuse Ultra Device and any unused and unsealed Vuse Ultra Pods back to us. The Return must reach us within twenty-eight (28) days of the Activation Date and we will send you a confirmation email when we receive the Products that you have returned. We will not charge you for the Vuse Ultra Device or any unused, sealed Vuse Ultra Pods returned to us within twenty-eight (28) days of the Activation Date.

 

4.3  Nothing in these Terms shall affect your statutory rights.  

 

5. Billing 

 

5.1  When you join the Vuse Ultra Trial, your Vuse Ultra Trial device fees will not be billed immediately upon the Activation Date. The Vuse Ultra Trial fees for the relevant Products will only be billed as follows:  

 

5.1.1  If you proceed with the Ultra Trial, you will be billed immediately the value of four pounds (£4) 

                                                                                                                    

5.1.2  If you have not initiated a Return, you will be billed for the Vuse Ultra Device on the (15th) day following the Activation Date in accordance with clause 14.   


Where you have provided more than one Payment Method, we reserve the right to update and/or otherwise amend your chosen Payment Method from time to time.   

 

5.1.3  By registering for the Vuse Ultra Trial, you authorise us to charge your Payment Method at the end of your Trial Period for your Vuse Ultra Trial in accordance with the applicable price(s) as published by us and as applicable from time to time. Please note that the Vuse payment facility is operated by Worldpay, who will process your chosen Payment Method on our behalf. Your use of the Vuse payment facility will be subject to their terms and conditions.You should ensure that you have read and agree with the Cybersource terms and conditionsbefore using the Vuse payment facility. 

 

5.1.4  CyberSource operates a secure server to process your payment details. They encrypt your credit or debit card (or other relevant) information and authorise payment directly. We will only keep the last four digits of your credit or debit card for our records and in order for you to recognise and choose your desired payment method without having to type in the details each time, therefore creating a more streamlined shopping experience for you. Payment card details are processed securely by our PCI DSS compliant payment service provider and are not stored on our systems. 5.1.5  If we are unable to obtain payment from you for your Vuse Ultra Trial order for any reason, we will notify you via e-mail asking you to resolve the problem. Your Vuse Ultra Trial will be placed on hold and no additional orders will be processed or shipped, nor will any Returns be accepted, until the problem has been resolved by you. If the payment issue is not resolved within a reasonable time from you being notified by us, we reserve the right to cancel your Vuse Ultra Trial immediately without notice to you. 

 

6. Delivery

 

6.1 Except as set out below, all Products are subject to next day delivery dispatch  (but note this excludes any weekend delivery options). Please see ourDelivery & Returnsterms for further information. 

 

6.2 Next day delivery will be provided for all Products without any additional fees being charged to you. 

 

6.3 Our next day delivery service is not available for Northern Ireland, Isle of Man, Channel Islands and Scottish Highlands and Islands, but standard delivery (excluding weekend delivery options) will be provided free of charge for all Products to be delivered to these areas.  

 

6.4  Delivery of all Products under the Vuse Ultra Trial will only be available to UK registered postal addresses.  

 

6.5  Please note that further delivery restrictions may apply to your Vuse Ultra Trial.For further information on delivery restrictions (in particular, relating to certain geographical delivery restrictions) please see ourDelivery & Returnsterms for further information. 

 

7. Return of Products 

 

7.1 We take steps to try and ensure that your Products are not damaged or defective. However, if you think you have received any damaged or defective Products, please contact our Vuse Ultra Care team for assistance. 

 

7.2  If you need any assistance or further information in returning any Products to us for any reason, please see the 'Delivery and Returns' section of our standard Terms and Conditions or contact our Vuse Ultra Care team for assistance. Please note that the Returns period for the Products purchased under the Vuse Ultra Trial are subject to the timeframes set out in clauses 14 and 15 above of these Terms, not the timeframes set out in our standard Terms and Conditions.  

 

7.3  You will not be required to pay any returns charges for unused, sealed Products returned to us in accordance with these Terms. 

 

8. Availability of Products 

 

8.1  There may be occasions when, despite our efforts, we are unable to dispatch the Products relating to your Vuse Ultra Trial. This may include (but is not limited to) circumstances where any of the Products in your Vuse Ultra Trial are out of stock (whether due to normal stock fluctuations or otherwise) or have otherwise been discontinued at the time your Vuse Ultra Trial Products are due to be dispatched. 


8.2  If any of the events under clause 30 arise,  you will receive an email from us to confirm there has been an issue with your Vuse Ultra Trial and that delivery of your Products will not take place. We will agree with you a suitable alternative to your Products (such as an alternative flavour of Vuse Ultra Pods), or if none can be agreed, you will not be charged for the Vuse Ultra Trial and you will not be sent any Products under the terms of the Vuse Ultra Trial.  

 

9. Data Protection 

 

9.1  Personal data that you provide to us by signing up to a Vuse Ultra Trial will only be used in accordance with these Terms and ourPrivacy Notice.Please ensure that you have read ourPrivacy Noticebefore proceeding. 

 

10. General 

 

10.1  We reserve the right to end any Vuse Ultra Trial and/or decline the creation of any Vuse Ultra Trial: 

 

    • at any time; 
    • for any reason; and 
    • without notice to you. 

 

10.2  We reserve the right (in our absolute discretion) to take any action we believe to be appropriate if we consider that any Vuse account holders are abusing the Vuse Ultra Trial services, which may include (but not limited to) terminating your  Account Profile and/or any other existing Vuse registered account which we reasonably believe belongs to you and/or any other account you make with us. 


10.3  If any provision of these Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force. 

 

10.4  A failure by Vuse to exercise, or delay in exercising, a right, power or remedy provided by these Terms or by law shall not constitute a waiver of that, or any other, right, power or remedy and shall not, and nor shall any single or partial exercise of any such right, power or remedy, preclude the further exercise of that, or any other, right, power or remedy. 

 

10.5  We do not accept any responsibility nor any liability (unless such liability cannot be lawfully excluded) for your use of the Vuse Ultra Trial (including but not limited to use of your Trial Account) where such use is undertaken in a manner which is inconsistent with these Terms, the Vuse account user Terms and/or theVuse Website Userterms. 

 

10.6  We do not accept responsibility and will not be liable (unless such liability cannot be lawfully excluded) for any losses, damages, expenses or other liabilities arising from or in connection with (whether direct or indirect) any technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind or for any errors solely due to your actions or omissions relating to a Vuse Ultra Trial or for any circumstances beyond our control, including but not limited to, accident, fire, flood, acts of God, strike, lock-out or other industrial disputes (whether or not involving our employees) or legislative or administrative interference. 

 

10.7  These Terms will be governed by English law and you hereby agree to submit to the exclusive jurisdiction of the courts of England and Wales.
